Will the Labour code turn back to billions of paid salaries?

The new Labour code should contain certain advantages of hired workers before employers. Such belief was expressed by the Chairman of the federation of trade unions of small and average enterprise of Ukraine Viacheslav Roi in article «Pendulum of the Labour code», placed in magazine "Narodniy deputat " (№7/8 (67-68), July-August, 2010).

According to V. Roi, the essence of the project of the Labour code which is accepted by the Supreme body of Ukraine in the first reading and prepares now for definitive acceptance, is «it legalizes those unfair advantages of employers which it is real, instead of on a letter of the hand-written law, have developed in Ukraine in labor relations for last 15-20 years».

The certificate of such advantages of V. Roi considers, in particular, «billions of not paid salaries, millions labor migrants, mass unemployment, scanty salaries of overwhelming majority of Ukrainians, pensions for which it is impossible to live,« envelopes », deficiency of the Pension fund».

The author of this article considers that developers of the bill-project haven't considered existing a situation in the country with mass non-observance of the operating labor legislation. «If by working out of the new labor legislation first of all to consider a present real condition of labor relations in Ukraine, - writes V. Roi, - we will inevitably come to such conclusion: today such Labour code which would offer certain advantages to hired workers in relations with employers … For the past two decades a pendulum of labor relations is necessary to the country has very strongly shaken towards employers, and that it has returned in due course to a balance point, its resolute course towards the worker» today is necessary.

V. Roi suggests to put powerful and unambiguous powers of trade unions as «only trade unions can talk as equals to employers» in the Labour code.

Also he offers, that the conclusion of the written labor contract of the employer and the worker was obligatory.

V. Roi has urged deputies of the Supreme Body of Ukraine not to rely that the project will be coordinated by trade unions and employers. « The labor code is accepted not by a consensus of trade unions and employers, and the decision of the highest legislative body which can and should establish not so much« paper »balance, how many really renews its real preferences to this or that party … the Problem of  Ukrainian  Deputies today consists, on my belief, in an establishment of such legislative rules of labor relations which would improve these relations in real life at the given concrete stage. And if for this purpose it is necessary to give certain advantage to hired workers – it is necessary to do it», - V. Roi has told.
