The law of Ukraine "About allowing system in economic activities sphere" № 2806-VI

This Law defines legal and organizational principles of functioning of allowing system in sphere of economic activities and establishes an order of activity of the allowing bodies, authorized to give out documents of allowing character, and the state managers.
 

According to item 1 of the Law of Ukraine "About allowing system in economic activities sphere" in economic activities sphere it is necessary to understand set of the relations settled by the legislation which arise between allowing bodies, the state managers and subjects of economic activities in connection with delivery of documents of allowing character, renewal, delivery of duplicates, cancellation of documents of allowing character as allowing system.
 

Action of this Law extends on allowing bodies, the state managers, the authorized body and subjects of economic activities who intend to conduct or conduct economic activities. According to item 4 it is exclusive laws which regulate the relations connected with reception of documents of allowing character, are established: necessity of reception of documents of allowing character and their kinds; the allowing body, authorized to give out the document of allowing character; payment or gratuitousness of delivery (renewal, duplicate deliveries, cancellation) the document of allowing character; term of delivery or granting of the written message on refusal in delivery of the document of allowing character; the exhaustive list of the bases for refusal in delivery, renewal, duplicate delivery, cancellation of the document of allowing character; Period of validity of the document of allowing character or limitlessness of period of validity of such document.
 

Delivery of documents of allowing character by local allowing bodies is carried out by a principle of organizational unity in the allowing center which work is coordinated by the state manager, in an order established by this Law.
 

The subject of economic activities has the right of a choice of a way of reception of documents of allowing character: directly under the reference to the state manager; under the reference to representatives of corresponding local allowing bodies which carry out reception of subjects of economic activities in the allowing center by a principle of organizational unity.
All statements concerning delivery of documents of allowing character and delivery of documents of allowing character are subject to obligatory registration by the state manager. The subject of economic activities has the right to carrying out of certain actions concerning realization of economic activities or kinds of economic activities on the basis of granting of the declaration without reception of the document of allowing character, except for those kinds of the economic activities which list is defined by the Cabinet of Ukraine.
 

In the Law of Ukraine "About allowing system in economic activities sphere" the basic requirements to an order of delivery of documents of allowing character or refusals in their delivery, renewals, deliveries of duplicates, cancellation of documents of allowing character also are specified; the primary goals and requirements to a post of the state manager as which it is necessary to understand the official of city council, cities regional and-or republican, value Autonomous republic Crimea (their executive powers), regional both regional in the cities of Kiev and Sevastopol state administrations, Kiev and Sevastopol city state administrations which organize delivery to subjects of economic activities of documents of allowing character and provide interaction of local allowing bodies; an order of conducting registers of documents of allowing character and an order of delivery of the last; Powers of the authorized body and responsibility in sphere of delivery of documents of allowing character.
