The law of Ukraine "About trade unions, their rights and activity guarantees" on 9/15/1999 № 1045-ХІV

This Law defines features of legal regulation, principles of creation, the right and a guarantee of activity of trade unions.

According to the law of Ukraine "About trade unions, their rights and activity guarantees" the trade union is defined as voluntary, not the profitable public organization which unites the citizens connected by the general interests by the nature of their professional (labor) activity (training) (item 1). Purpose of activity of trade unions is representation, realization and protection of the labor, social and economic rights and interests of members of trade unions (item 2). Any restriction of the rights or an establishment of advantages is forbidden at drawing up, change or the termination of the labor contract in connection with an accessory or not an accessory to trade unions or certain trade union, the introduction into it or an exit from it. Trade unions in the activity are independent of public authorities and local governments, employers, other civil organizations, political parties, to them not accountable and aren't under control.

The accessory or not an accessory to trade unions doesn't cause any restrictions of the labor, social and economic, political, personal rights and freedom of the citizens guaranteed by the Constitution of Ukraine and other regulatory legal acts of Ukraine. Trade unions operate according to the legislation and to the charters which are accepted by congresses, conferences, constituent or general gathering of members of trade union of corresponding level and shouldn't contradict the legislation of Ukraine. Deserves to be allocated basic position that in questions of collective interests of workers trade unions carry out representation and protection of interests of workers irrespective of their membership in trade unions. The primary goal of trade unions is the representation and protection of interests of workers before the owner. Proceeding from these problems, as the basic functions of activity of trade unions act protective and representation which are supplemented with control powers on observance of the legislation on work.

Section ІІ of the Law of Ukraine "About trade unions, their rights and activity guarantees" fixes fundamental laws of trade unions, in particular the right of trade unions, their associations to represent and protect the rights and interests of members of trade unions, the right to conducting collective negotiations and drawing up of collective agreements and agreements, the rights of trade unions in maintenance of employment of the population, the right concerning social protection and maintenance of sufficient social level of citizens, the rights of trade unions in the field of social insurance, the rights of trade unions and their associations in the permission of labor disputes.

The section of III Law of Ukraine «About trade unions, their rights and activity guarantees» has the name "the PRIMARY TRADE-UNION ORGANIZATIONS AT the ENTERPRISES, In ESTABLISHMENTS, the ORGANIZATIONS". In it main principles of activity of the primary trade-union organizations (the primary organization of trade union - voluntary association of members of trade union which, as a rule, work at one enterprise, in establishment, the organizations irrespective of pattern of ownership and a kind of economic activities or at the physical person who uses hired work force, or provide themselves with work independently, or study in one educational institution), powers of their elective bodies are shined.

Also this law the provided variety of guarantees of activity of trade unions (section ІV) to which, in particular, it is necessary to carry: Duty of the employer to create appropriate conditions for activity of trade unions and variety of the rights, which members and plenipotentiaries of elective bodies of trade unions have (to demand and receive from the employer, other official corresponding documents, data and explanations which concern working conditions, performance of collective agreements and agreements, observance of the legislation on work and the social and economic rights of workers; to check work of institutions of trade, public catering, public health services, children's institutions, hostels, Transport agencies, the enterprises which are engaged in granting of household services which belong to the given enterprise, to establishment, the organizations or them serve; directly to address on trade-union questions orally or in writing to the employer, officials and other).Article 46 the Law of Ukraine "About trade unions, their rights and activity guarantees" directly provides responsibility for non-observance of norms of the given law.
