The reference to the President of Ukraine

Experts of Federation of trade unions of workers of cooperation and other forms of enterprise of Ukraine (now it is called Federation of trade unions of workers of small and average enterprise of Ukraine) had been prepared REFERENCES To the PRESIDENT of Ukraine which the Head of Federation Kozhevina N. has handed over at a meeting of trade unions with the President at the 19th march 2010.

Dear mr. Pesident!
 

Small-scale business is an important element of development of economy, filling of the budget, gross national product increase (a total internal product), creations of new workplaces, saturation of the market by the goods, services, that is solves economic, social and many other problems in Ukraine.

The effective state policy of support of sector of small and average business will create a favorable investment climate, will connect processes of a structural policy and formation of the Ukrainian market.

Today the sector of small business in Ukraine suffers from administrative and other obstacles, namely:

• a considerable quantity of administrative barriers (registration, licensing, certifications, the monitoring system and allowing practice, manual regulation of rent relations etc. );
• absence of accurately formulated legislative base of a state policy in sphere of support of small enterprise ;
• absence of real and effective mechanisms of financially-credit support;
• burdening system of the reporting and an excessive tax crush. First of all it is high charges on fund of payment which induces separate subjects of enterprise activity essentially to reduce volumes of the official reporting and to conduct double-entry bookkeeping, to increase "shadow" cash calculations;
• imperfect legislative base from drawing up of collective agreements in sphere of small and average enterprise ;
• absence of real protection of hired workers at acceptance for work, abusing the right of a trial period and training from employers;
• excessive intervention of public authorities in activity of subjects of economic activities;
• uncertainty of businessmen in stability of conditions of business dealing.

Realizing the place in social and economic system, trade unions of workers of small and average business address for the state support for activity strengthening on protection of the rights workers in the sphere of small enterprise.

The payment of small and average business in economic crisis overcoming can be heavy overestimating, in this reason public organizations which unite businessmen of the country, consider that  the power can and even is obliged to listen to their opinion.

Obvious there is a necessity of the complex decision of problems of support of small-scale business in Ukraine.

As exceptions of the general rule of neglect public opinion, it’s possible to result a positive example of work of the state committee concerning business and Are glad businessmen at the cabinet of Ukraine. There is a constructive, at high professional level the rights of businessmen settle and business regulator policy is formed environment favorable for small. The harmonious and consecutive work concerning formation and realization state regulator politicians, politicians in sphere of the state registration, licensing and allowing system in economic activities sphere is spent, promotes formation of system of financially and credit, consulting and information support of business.

We address to you with hope that in Ukraine by means of your initiative, persistence, resoluteness in questions of development of small and average business the constant and appropriate attention at all steps of the power not in words, and in practice will be taken away.

The federation of trade unions of workers of cooperation and other forms of enterprise of Ukraine addresses to you with the request to consider our offers which can positively affect development of small and average business in Ukraine and increase of social standards.
 

1. To carry out support of small and average business according to the National program of assistance of development of small business in Ukraine and your Electoral programme "the Working country is the reliable future!"
2. To deepen social dialogue at regional and branch levels, to promote development of trade unions and branch councils of businessmen in regions, to extend activity of branch and regional agreements to the enterprises of all patterns of ownership and the trade-union organizations which aren't a part of Federation of trade unions of Ukraine. To initiate changes in the legislation which to provide compulsion of drawing up of collective agreements at all enterprises irrespective of patterns of ownership and economic activities kinds, to realize in the legislation the offer of the Ministry of a labor safety on definition of degrees of responsibility for maintenance of procedure of the conclusion and performance of collective agreements and agreements.
3. To accept drastic measures on prevention of unemployment, creation of new workplaces and overcoming of a shadow salary. To enter in Ukraine a uniform social payment on obligatory state social insurance with real reduction of loading by Fund of payment and obligatory state medical insurance. To define the mechanism of granting of gratuitous medical aid to people who aren't insured, to pensioners and needy.
4. To stimulate development of innovative small and average business, its infrastructure for the purpose of attraction of investments and an overcoming the crisis.
5. To settle relations of land owners and builders of objects of real estate, buildings, constructions in a part impossibility of registration of the property right without the coordination with other party member of the contract.
6. To provide steady performance of the law "About regulator policy ", to involve  Are glad businessmen at the Cabinet of Ukraine, representatives of regional and branch councils, associations of businessmen and trade unions in preparation and processing of projects of regulatory legal acts which business regulations in Ukraine concern; legislative initiatives concerning small-scale business to submit only after discussion with public organizations of businessmen and trade unions taking into account their consent.
7. Appointment of the Head of the state committee concerning business to spend under condition of the obligatory coordination with Glad businessmen at the Cabinet of Ukraine, public organizations, branch councils of businessmen.
8. To reduce tax loading, it is essential to reduce means for licenses, patents etc. and to keep the uniform tax.
9. To create conditions of business dealing for the people, which itself provide with work, to give tax and credit vacation for beginning businessmen.
10. To develop the mechanism of a non-admission of abusing employers at training or trial period use at acceptance for work.
11. To strengthen positions of trade unions in the decision of questions of protection and payment at the enterprises of all patterns of ownership, to provide financing of technical inspectors of branch committees of trade unions at the expense of social insurance means.
12. Legislatively to provide position of migrants equal in rights concerning conditions of employment, social security and other rights according to the convention of the International Bureau of Work.
13. To provide performance of article 44 of the Law of Ukraine "About trade unions, their rights and an activity guarantee" concerning deduction of means by the enterprises, establishments, the organizations to the primary trade-union organizations for cultural-mass, sports and improving work.
